BACKGROUND 

L’eau est une ressource essentielle au développement durable, à la préservation de l’environnement et à la satisfaction des besoins fondamentaux des populations. Cependant, sa gestion durable est confrontée à des défis croissants liés à la pression démographique, aux changements climatiques et aux diverses activités humaines. Dans le cadre de la mise en œuvre de la Politique Générale de l’État axée sur la valorisation du capital humain et l’amélioration de la gouvernance du secteur, le Ministère de l’Eau, de l’Assainissement et de l’Hygiène redouble d’efforts pour renforcer la gouvernance du secteur. L’objectif est d’améliorer l’accès à l’eau potable, de développer les infrastructures d’assainissement, de promouvoir des comportements favorables à l’hygiène et d’assurer une gestion durable des ressources en eau. Dans ce contexte, il a été constaté que, certaines dispositions des cadres juridiques envigueur sont caducs et ne répondent plus aux défis et aux besoins actuels du secteur. Aussi, pour garantir une approche efficace des stratégies et des actions futures dans le secteur de l'eau et de l'assainissement (EAH), en accord avec les récentes évolutions législatives et les engagements internationaux du pays,, il s’avère incontournable de procéder à la mise à jour de la loi n° 98-029 du 20 janvier 1999 portant code de l’eau et ses textes d’applications. 

PURPOSE OF THE CONSULTANCY 

  • Mise en place d’un Comité de rédaction du Code de l’Eau actualisé, composé des juristes représentant les Institutions et les Ministères concernés ; Consultation des parties prenantes dans le secteur EAH ; 

  • Rédaction progressive des différentes moutures du projet de Loi 

  • Atelier de finalisation de rédaction avec les parties prenantes. 

  • Première examen de l’APL devant la Commission de Réforme du Système Pénal (CRSP). 

     

    Deliverables 

    Le consultant remettra les livrables ci-après : 

    • Rapports intermédiaires comprenant les drafts améliorés du projet de texte concerné, à l'issue des réunions et/ou ateliers, incluant les observations et propositions recueillies, qu'elles soient des ajouts ou des suppressions 

    • Projet de Code de l’Eau version finale, incluant le sommaire et les exposés des motifs après observations et recommandations au niveau des parlements. 

      Qualifications, experience, skills and languages 

      Educational Qualifications: 

      Essential: Diplôme de Master II en Droit public délivré par un établissement reconnu par la Fonction Publique ; 

      Experiences 

      Essential: Au moins 2 ans d’expériences professionnelles pertinentes et avérées dans la rédaction des textes juridiques 

      Skills/Knowledge: 

      Essential :  Bonne connaissance en droit administratif et des mécanismes de financements du secteur EAH notamment les Partenariats Public Privé ; 

      Désirable : 

      • Connaissance de la réglementation régissant le secteur de l’Eau, de l’Assainissement et de l’Hygiène 

      • Une capacité à travailler en équipe tout en étant autonome et à respecter les délais 

      • Des compétences rédactionnelles solides.
