As per ST/AI/2013/4/Rev.1) Task 1: Legal, policy, and comparative analysis Objective: To identify legal, regulatory, and institutional gaps in Indonesia’s current beneficial ownership framework, assess its alignment with international standards, and identify effective regulatory and institutional models to inform the amendment of Presidential Regulation No. 13 of 2018. Activities: a. Review Presidential Regulation No. 13 of 2018 and all relevant implementing laws, regulations, and policies and assess gaps and inconsistencies against FATF Recommendations, UNCAC provisions, Open Ownership Principles, and other relevant international best practices. b. Map institutional mandates, roles, and responsibilities, including coordination mechanisms among relevant authorities, and identify implementation challenges. c. Conduct a comparative analysis of beneficial ownership regulatory frameworks from selected regional and global jurisdictions recognized as leaders in ownership transparency. d. Identify and document good practices related to beneficial ownership definitions, disclosure thresholds, verification mechanisms, sanctions, enforcement, and public access to information. Target: A Gap Analysis Report (Indonesian and English) identifying legal, regulatory, and institutional gaps in Presidential Regulation No. 13 of 2018, benchmarked against relevant international standards and other countries’ good practices. Task 2: Stakeholder Consultations Objective: To ensure that the amendment process is informed by practical implementation experience and stakeholder perspectives. Activities: a. Facilitate and conduct Focus Group Discussions (FGDs) and key informant interviews with relevant government institutions, regulators, law enforcement agencies, private sector representatives, and civil society organizations. b. Collect and document stakeholder inputs on challenges, risks, institutional needs, and operational considerations related to beneficial ownership disclosure and enforcement. Target: Stakeholder Consultation (FGD) Report Task 3: Drafting of Policy and Regulatory Recommendations Objective: To develop concrete, actionable recommendations to strengthen Presidential Regulation No. 13 of 2018. Activities: a. Draft policy and regulatory recommendations for the amendment of Presidential Regulation No. 13 of 2018, covering, where applicable: 1) Definition and scope of beneficial ownership; 2) Disclosure requirements and reporting obligations; 3) Verification and monitoring mechanisms; 4) Sanctions and enforcement measures; 5) Inter-agency coordination and data-sharing protocols (interoperability standards); 6) Public access and data integrity standards; 7) Dormant companies status b. Model regulatory provisions; Ensure recommendations are practical, enforceable, and aligned with Indonesia’s legal system and institutional capacities. Legal, policy, and comparative analysis of Indonesia’s current beneficial ownership framework 2. Stakeholder Consultations to ensure that the amendment process is informed by practical implementation experience and stakeholder perspectives; 3. Drafting of Policy and Regulatory Recommendations to strengthen Presidential Regulation No. 13 of 2018. Qualifications/special skillsAcademic qualifications An advanced university degree (Master’s degree or equivalent) in Law, or a related field is required. A first-level university degree (Bachelor’s degree or equivalent) in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree. LanguagesLanguages English and French are the working languages of the United Nations Secretariat. For this position, fluency in English, with excellent drafting and communication skills, is required. For this position, oral and written fluency in Indonesia is required.
