A two-day capacity-building session for instructors and the Prosecution Training Institute team responsible for managing and delivering the e-learning modules, conducted. Background of the Assignment As the global guardian of the United Nations standards and norms in crime prevention and criminal justice the United Nations Office on Drugs and Crime (UNODC) is mandated to support Member States in upholding the rule of law, promoting crime prevention and effective, fair, humane and accountable criminal justice systems. In line with UNODCโs mission and mandate, the UNODC Strategy 2021-2025, UNODC Strategic Vision for Africa 2030, UNODC Regional Programme for Eastern Africa (2016-2023), at UNODC headquarters, the Criminal Justice Programme of ROEA seeks to implement these objectives through support of major justice reforms processes undertaken by East African States. In adherence with this mandate, and in line with the priorities of the UN Kenya Sustainable Development Cooperation Framework 2022-2026, the second phase of the Programme for Legal Empowerment and Aid Delivery in Kenya (PLEAD II) was designed to support the Republic of Kenyaโs adherence to international norms and standards on crime prevention, criminal justice, anti-corruption and human rights. The design of PLEAD II is informed by Kenyaโs justice sector reform agenda, current priorities of key criminal justice institutions and citizensโ expectations, as well as the achievements and lessons learned during phase one of PLEAD. The Programme is funded by the European Union and targets nineteen (19) counties in Kenya. The Office of the Director of Public Prosecutions (ODPP) is the National Prosecution Authority mandated under Article 157 of the Constitution of Kenya, to exercise state powers of prosecution, including to institute and undertake criminal proceedings, take over and continue any criminal proceedings commenced in any court and discontinue at any stage before judgment is delivered any criminal proceedings. The ODPP endeavors to equip staff with requisite skills and capabilities necessary to deliver their mandate and to adopt international best practices within the country. This is spearheaded by the Prosecutions Training Institute (PTI), to provide continuous professional training and education to the members of staff in all aspects. UNODC PLEAD proposes to develop e-learning modules for the ODPP on topical thematic areas within their existing digital learning platform. This proposed support seeks to amplify training efforts and increase access to knowledge to prosecutors across the country without relegating them from their duties. PLEAD has previously supported the ODPP to develop instruments on alternatives to prosecution and trial through the development of the ODPP Diversion Policy; Diversion Guidelines and Explanatory Notes; and Plea-Bargaining Guidelines (co-funded with USDoJ). To this end, a consultant / training content developer will be engaged to develop a comprehensive, updated online content on Diversion and Plea Bargaining; adapted to the adult learner on a professional setting. 2. Purpose of the Assignment The consultant will be responsible to develop two (2) e-learning modules on Diversion and Plea Bargaining for the Office of the Director of Public Prosecutions (ODPP) in Kenya. The modules will be text-based, in English language, with real case scenarios, videos and illustrations. 3. Specific tasks to be performed by the consultant The consultant will be responsible for developing two (2) e-learning modules on Diversion and Plea Bargaining for the Office of the Director of Public Prosecutions (ODPP) in Kenya. The modules will be text-based, in English language, with real case scenarios, videos and illustrations. a) Development of the following e-learning and text-based modules based on the provided format by the ODPP eLearning Platform. The Consultant shall acquaint him/herself with the current ODPP Learning Management System (LMS) and be guided accordingly in the development of the two modules. Below are the key features of the two modules: i. Module on prosecutorial approaches, roles and responsibilities on effective implementation of Diversion; ii. Module on prosecutorial approaches, roles and responsibilities on effective implementation of Plea Bargaining; iii. Incorporation of relevant real case scenarios, videos and illustrations to the modules; iv. Development of multiple-choice questions and quizzes within the modules, and at the end of each module; v. Prepare a final examination with multiple-choice questions incorporating all the modules; vi. Engage in continuous consultations and coordinate with the ODPP Prosecution Training Institute (PTI) in packaging of the online content on their internal e-learning platform; vii. Incorporate forum assignments and give provision for interactive lessons viii. Develop and implement proposals on the monitoring tool for participants to ensure full and effective participation; ix. The above modules shall be guided by the relevant ODPP and other justice sector policies and strategies on diversion and plea bargaining, including: - ODPP Diversion Policy - ODPP Diversion Guidelines and Explanatory Notes - ODPP Plea Bargaining Guidelines - A Prosecutorโs Guide to Children in the Criminal Justice System - NCAJ National Strategy on Justice for Children 2023 - 2028 b) Undertake a two-days validation session of the two (2) modules on Diversion and Plea Bargaining. c) Submit final, comprehensive and validated modules on Diversion and Plea Bargaining. d) Undertake a two-days capacity building session of the instructors and the Prosecution Training Institute team who will be required to manage the trainings of the respective e-learning modules. i. Provide training sessions including hands-on training and capacity-building support to designated personnel within the Prosecution Training Institute for effective implementation and utilization of the eLearning modules. ii. Address any questions or concerns raised during training. e) Reporting and other requirements: The consultant will: - Submit the two (2) eLearning text-based modules on prosecutorial responses to Diversion and Plea-Bargaining cases; - Submit a final, comprehensive and output-oriented report, submitted not later than three working days prior to the end of the consultancy. Qualifications/special skillsAn advanced university degree (Master's degree or equivalent) in law, social sciences, criminology, or a related field is required. A first-level university degree in similar fields in combination with two additional years of qualifying experience may be accepted in lieu of the advanced university degree. - At least seven (07) years of relevant work experience in training and development of training modules in the field of criminal justice reform, human rights and/or rule of law is required. - Experience in implementation of alternatives to prosecution and trial in a commonwealth jurisdiction is desirable. - Knowledge of the criminal justice sector in Kenya is desirable. - Experience of providing technical advice to multi-disciplinary teams in government or national stakeholders or international organizations is desirable. LanguagesEnglish and French are the working languages of the United Nations Secretariat. For this position, fluency in oral and written English is required.
